A state District Judge on Wednesday ruled Ricky G. Leyba, 27, will stand trial on charges he shot two men outside Cheeks nightclub, 2841 Cerrillos Road, in August.
During a daylong preliminary hearing, Chief Deputy District Attorney Doug Couleur presented enough evidence for state District Judge Michael Vigil to find probable cause to bind Leyba over for trial facing with two counts of aggravated battery with a deadly weapon.
A date for the trial has not been set.
Santa Fe police arrested Leyba days after the Aug. 12 shooting, stating in a criminal complaint he shot Joe Corriz, 40, and Steven Quintana, 36, during a scuffle outside the nightclub that did not originate between Leyba and the men.
Corriz had his leg amputated in the shooting.
Defense attorney Dan Marlowe says Leyba has a strong case for self defense.
Leyba remains out of jail on a $25,000 surety bond while he awaits trial.
