Man guilty of possession of child porn gets to avoid sex registration

A 33-year-old Santa Fe man who left a flash drive full of child pornography at the Santa Fe Community College last year won’t have to register as a sex offender if he can successfully complete five years of intense probation.

The level of probation Patrick Rios was slapped with Monday as part of his plea agreement with the state is the same level of intense probation that convicted sex offenders receive and will limit where he can live and when he is able to visit children.

But if he makes it through five years of that, he won’t have the lifelong brand of being a sex offender on online registries around the country for convicted sex offenders.

Deputy DA Cynthia Hill said she would have preferred Rios still have to register because his was a case not just of possession child porn, but of a man who has “taken the next step” and used a video camera to film sex acts with adults and of young girls walking outside his home. That, Hill says, is a disturbing warning sign for potential future problems.
