Judge to decide if woman should stand trial for stabbing longtime boyfriend

State District Judge Michael Vigil today is supposed to decide at a preliminary hearing whether Diana Urban, 45, should stand trial for 2nd degree murder for the November stabbing death of her longtime live-in boyfriend Jerome Atencio.

Urban claims Atencio was trying to rape her and she was defending herself. The two had a long history of domestic abuse with one another according to family accounts and police records. The probable cause statement for Urban’s arrest drafted by Santa Fe police in November also mentions allegations of Urban possibly kissing a 23-year-old man in the home she stabbed Atencio in, possibly leading to an Atencio outburst and him hitting her.

Atencio was charged in 2008 with aggravated assault against a household member for allegedly punching Urban, but a forensic evaluation ruled Atencio was not competent to stand trial. The case was dismissed when, according to court records, an assistant district attorney did not show up to two hearings in May 2009 to address the competency findings, according to the order signed by state District Judge Stephen Pfeffer.

Interesting dynamics with this one (past domestic violence allegations on both sides, self defense claims, mental health issues, etc.). I’ll update when I hear whether the woman will have to stand trial.
