Magistrate judge’s son arrested at Santa Fe High

Chalk this one up under the no big deal category based on the charges themselves, but still worth reporting if for no other reason than to make sure the case gets handled properly and like any other case of similar charges.

When a local judge has a family member arrested, its worth shining some light on. The 18-year-old son of Santa Fe County Magistrate Judge George Anaya Jr. was arrested this week and charged with having a knife on school grounds and being in possession of drug paraphernalia. The allegations (see below) aren’t horrendous by any means.


From Friday’s New Mexican (Local Briefs section):

Matthew D. Anaya, the 18-year-old son of Santa Fe County Magistrate Judge George Anaya Jr., was arrested Wednesday and charged with carrying a deadly weapon on school grounds and possession of drug paraphernalia.

According to a statement of probable cause filed for his arrest, a Santa Fe High School security guard says he observed Matthew Anaya “standing near the bus drop off zone smoking what appeared to be a marijuana cigarette.”

The court document states the teenager was later “searched by Santa Fe High School Principal Robert Stevens (who) located a folding knife and a glass pipe … in the pocket of a pair of pajama bottoms underneath defendant’s pants.”

Matthew Anaya spent the night in the Santa Fe County jail and was released on his own recognizance after being arraigned Thursday.

Santa Fe County Magistrate Judge David Segura handled Anaya’s arraignment/initial appearance in court, which is fine… and probably not an uncommon decision at all to release him on his own recognizance considering the charges.

Don’t count on any local judge handling this case moving forward though. It will have to be conflicted out to another judge likely.

    I would like to comment on todays article. I am the wife of Judge George Anaya, Jr and very proud of the example he set for our children! I would like to enlighten your staff and readers of the full situation. Matthew came from a very troubled back ground and we fostered then adopted him five years ago while he was dealing with cancer and the death if his older brother. While this is not an excuse but more a true and informed statement, Matthew must be treated the same as any other 18 year old in these same circumstances. Thank you to all our family and friends who understand and now the situation we are dealing with at this time.

      Well I am Matthew Anaya, and to let everyone know i was not smoking anything. Passing a Cigarette to a friend when the guard came wondering up the stairs. A cold case of bad time bad place, yes I had a pipe and knife… Never used them at school, still smoke bud and I’m doing great! School paid for and a job, no criminal background so weed is not to blame.
